Under this pure no-fault system of coverage, workers who are injured or made ill by their jobs are entitled to:
- 100% coverage for all medical costs
- 66 2/3% of their average weekly wages, up to a maximum set by the state, for as long as they are temporarily disabled
- A permanent disability award in the event of a permanent injury (granted under guidelines set by the state)
- A death benefit paid to dependents in the event of a fatal injury
There is one stipulation for coverage: the injury must arise by way of the injured person’s employment and occur during the course of it. Employees filing a Workman's Comp claim and accepting Workman's Compensation coverage lose the right to sue an employer for recovery of damages resulting from the injury.
